Andrew Douglas Solicitors will assist you in negotiating the terms of your lease to your advantage. We further advise on such issues as your rights and obligations under the lease, the costs associated with the lease and whether you wish to pay for registration of the lease and the mortgagee's consent for further insurance. In drafting your lease we can protect your rights in a range of aspects including:
      • clarification of rent outgoings
      • stamp duty assessments
      • assignment of leases and sub-leases
      • exercise of options to renew
      • rent reviews
      • personal guarantees and other securities
      • insurance requirements
      • options to purchase
Our fixed fee prices for our leases are as follows:
New Commercial Lease if drafting
$675* + GST (including $17.11 title search and sundries but excluding other searches) + any surrender of old lease ($475 + GST if tenant co-operates) + any titles office registration fee** (optional but recommended) + any Mortgagee Consent fee*** (optional but recommended).
New Retail Shop Lease if drafting
$850* + GST and otherwise as set out above.
New Lease advice if perusing
$195 / hour + GST for advice and negotiating amendments.
Assignment or Extension of Lease if acting for Lessor
$575* + GST and otherwise as set out above + negotiating Amendments at $195 / hour + GST.
Assignment of Lease if acting for Existing Tenant $200 + GST# (including title search) or $300 + GST for Retail Shop Lease + Lessor's legal costs.
Assignment of Lease if acting for New Tenant $200 + GST (including title search) or $300 + GST for Retail Shop Lease + any lease advice or amendments at $195 + GST / hour.

* There is also an additional professional fee if we are required to register a lease or to arrange and execute personal or bank guarantee documents or mortgagee consent documents or to obtain financial information from a new tenant or big shopping centre lease at $100 + GST for each of these optional requirements.

** At least $120.50 registration fees + $32.35 if survey plan required + the same again if extra title deeds are covered by lease + surveyor's fees if no survey plan available.

*** Usually $50-$150 depending on the financier's charge.

# Add $100 + GST if the lessor refuses to negotiate directly with the purchaser when required and insists upon all communication through the vendor.
