When disputes develop, we will advise as to options for resolution and when appropriate encourage alternative dispute resolution options such as mediation or a barrister's opinion to double check your prospects of success.

We are happy to assist with any disputes that develop into litigation for existing clients or for any conveyancing disputes. If it is necessary to institute proceedings, we will prepare documents and brief barristers within the appropriate specialty to check them or appear in Court if necessary so that you have the correct litigation specialist on your side.

Cost estimates will be obtained from the barrister and combined with our estimates for any assistance they may require before or after an initial advice at $265 / hour + GST.

The cost estimates will be followed in the absence of unforeseen complications and our precise method of charging will be in accordance with the Family Court Scale + 25%. We use that scale for all work in our office because the other scales are, in our opinion, difficult to understand and apply.

That scale is based upon the work actually performed by allowing a certain amount for each letter and phone call etc as opposed to time costing which is based on time and some would argue, can reward inefficiency and be unpredictable. Any costs order in the Family Court is therefore based on that scale and the gap represents the size of a typical gap between your legal costs and the costs you can recover (like the 25% medicare gap for health).
